Failure to follow any term or condition will be grounds for immediate account deactivation without notice. Hosting4Wealth will be the sole arbiter as to what constitutes a violation of any of these provisions.

Activity which results in the suspension or deactivation of an account will result in a forfeiture of all fees paid. Complaints made regarding abuses of an account will be investigated and if found guilty will be grounds for immediate suspension.

Use Prohibited

Child Pornography - Child Erotica

Federal child exploitation statutes set forth the illegality of possession, production, reception, transport or distribution of any sexually explicit depiction of children.

Any user found to commit this type of abuse will have service suspended immediately until remedy or face service termination. Repeat offenders will be promptly terminated.

Illegal Use

Users may not transmit, retransmit or store materials in violation of any federal, state or local laws or regulations. Users may not abuse or fraudulently use products or services offered by Hosting4Wealth nor allow/permit such use by clients or third parties. This includes, but is not limited to: copyrighted material, trademark, trade secret or other intellectual property right used without proper authorization, prescription drug sales, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws or the laws of united states of america.

Examples of non-acceptable content or links:

• Copyrighted media, without authority to distribute or display,
• Unlicensed applications,
• Cracking programs or key generators,
• Child pornography or kidnapping material,
• Fraudulent activity, phishing, pyramid schemes, chain letters, forgery, or impersonation,
• Terrorist propaganda, racist material, or bomb/weapon instructions,
• Virus/Virii, Spyware, Malware, or other infectious material,
• Material protected by trade secret or other statute,
• Pirated software,
• Hackers programs or archives,
• Warez sites,
• MP3,
• File & Data Hosting
• and IRC and associated programs (including psybnc, "bots", etc...)

Additionally, Hosting4Wealth.net prohibits:

• Scripts commonly used for abuse, attacks, or flooding,
• Threatening, harrassing, or obscene content,
• Any proxies which do not require authentication (including open mail proxies, unprotected anonymous web surfing proxies, etc...),

Links to unacceptable content, as defined above, are also prohibited.

The subscriber to Hosting4Wealth service agrees to indemnify and hold harmless Hosting4Wealth from any claims resulting from the use of the service that damages the subscriber or any other party.

No online pharmacies are allowed on our network.

Sites related to HYIP (High Yield Investment Programs), Ponzi schemes or pyramid schemes are prohibited.

Hosting4Wealth will be the sole arbiter as to what constitutes a violation of this provision.

Adult Content

Legal Adult Content is allowed.

Security

Violations of system or network security are prohibited, and may result in criminal and civil liability. Examples include, but are not limited to the following: Unauthorized access, use, probe, or scan of a systems security or authentication measures, data or traffic. Interference with service to any user, host or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system and broadcast attacks. Forging of any TCP-IP packet header or any part of the header information in an email or a newsgroup posting.

Server Resource

Any website that uses a high amount of server resources (such as, but not limited to, CPU time, memory usage, and network resources) will be given an option of either paying extra for a dedicated server / semi-dedicated server (which depends on the resource needed) or reducing the resource used to an acceptable level. Hosting4Wealth shall be the sole arbiter of what is considered to be a high server usage level. (Please refer to Resource Abuse Policy here)

Chat Rooms

Hosting4Wealth does not provide nor allow chat room's On shared hosting environments. You may elect for a Dedicated Server to Run a chat room efficiently

Background Running Programs

Hosting4Wealth does not allow background Daemons such as IRC bots; eggdrop; BitchX; XiRCON; and any other program that interferes with normal server operation.

SSH Access (Jail-Shell Only)

At anytime, user may request to Hosting4Wealth server administrator to enable SSH (Jail-Shell) access to his/her account for a period of 72 hours only and Hosting4Wealth will issue a one time access fee of $5.00 for the requested SSH (Jail-Shell) access for each domain on each time. Once payment made for SSH (Jail-Shell) request, his/her account will be granted the permission to use the SSH (Jail-Shell) access for a period of 72 hours. (Payments are non refundable)

IRC

Hosting4Wealth does not allow IRC server, IRC bots, or IRC shells to be operated on our network.

Banned Scripts

We do not allow proxy servers or scripts, torrent trackers or torrent clients to be run from our shared/reseller hosting servers.

Backups

Hosting4Wealth performs daily backups on all servers to ensure critical files are never lost. However Hosting4Wealth is NOT responsible for lost data, time, income or any other resource due to faulty backups or non-existent backups. Please always backup your own data for redundancy. Any user that need us to restore a backup for their hosting account due an error made beyond our control, there is a $5.00 one time fee required. If your account or data is lost due to system or drive we will restore it at no additional charge. The data on our shared servers are backed up on a separate hard drive on a weekly and/or daily basis. Due to the nature of hard drives having errors or issues we can not ensure 100% recovery, however we will always strive to recover 100%. The charge for the restore is used to maintain the highest level of security and integrity on our backups and to strive to be able to help you restore data which may be unrecoverable without backups.

Client Responsibility

The client is responsible for all activity originating from the account unless proven to be a victim of outside hacking or address forgery. The client is responsible for securing their username/password. The client assumes responsibility for all material on their site that may be put on by a third party (such as the usage of Free For All links pages). Use of Hosting4Wealth's service requires a certain level of knowledge in the use of Internet languages, protocols, and software. This level of knowledge varies depending on the anticipated use and desired content of the web space by the client.

The following examples are offered: Web Publishing: requires knowledge of HTML, properly locating and linking documents, FTPing Web contents, Graphics, text, sound, image mapping, etc. FrontPage web publishing: knowledge of the FrontPage tools as well as Telnet and FTP understanding and capability. CGI-Scripts: requires a knowledge of the UNIX environment, TAR & GUNZIP commands, Perl, C Shell scripts, permissions, etc. Mail: a use of mail clients to receive and send mail, etc. The client agrees that he or she has the necessary knowledge to create and maintain their web space. Client agrees that it is not the responsibility of Hosting4Wealth to provide this knowledge or support outside matter specific to Hosting4Wealth servers.

Network Filtering/Blocking

Users in violation of any provision set forth in this document may have content or traffic blocked or filtered as a remedy of abuse. Notification of such filtering/blocking likely will be sent to the user, however there is no guarantee that such notification will be sent. Filtering/blocking may be manual or automatic depending on the nature of the offense.

Software Distribution

Hosting4Wealth's shared Web Hosting accounts are not to be used for the purposes of distributing software and multimedia products. If you wish to distribute software and/or multimedia files, please contact sales[AT]Hosting4Wealth for special arrangement.

Multimedia Files

Multimedia files are defined as any graphics, audio, and video files. Hosting4Wealth.net Web Hosting accounts are not to be used for the purposes of distributing and storing unusual amount of multimedia files. Any Web site whose disk space usage for storing the multimedia files exceed 70% of its total usage, either in terms of total size or number of files, will be deemed to be using unusual amount of multimedia files.

Domain Names

Hosting4Wealth will take necessary steps to register domain names on behalf of the client when requested. However, clients are responsible for renewing their domain names. Hosting4Wealth does not take responsibility for failing to renew domain names. If your domain name was registered via our company, you must check and take appropriate actions to renew a domain that is about to expire. We do not handle renewals unless specifically asked for by sending a ticket to our helpdesk.

Account Migration/Transfer

Hosting4Wealth provides free account migration/transfer up to a total of 100 accounts migration/transfer of data from the other hosting provider during it's first 72 hours after the order had been confirmed and for each subsequent hosting account which needed to perform an account migration/transfer there will be a charge of $2.00 per domain account requested for the transfer.

Email - READ CAREFULLY

The sending of bulk mail is ONLY permitted AFTER Confirmed Opt-In has been verified by the Abuse Desk. Starting such a mail campaign without the approval of Hosting4Wealth's Abuse Desk will result in service suspension until verification and approval has been made. Complaints generated in regards to bulk mail are immediately deemed as proof that the recipient did not request such emails and therefore is considered abuse.

Prohibited:

• Spam. Sending Unsolicited Bulk Email (UBE) or Unsolicited Commercial Email (UCE) for any purpose whatsoever.
• Spamvertising. Having third parties send out UBE /UCE on any user's behalf to advertise URLs or any service on Hosting4Wealth's network.

First Spam Abuse Notification (Hosting4Wealth -> Client):

• Provide the Abuse Notification to the client, and assess a $50 fine. Failure to pay the fine within 24 hours may result in service interruption, due to suspension.
• After three Abuse Notifications are issued service may be subject to termination, as well as ineligibility to order any future hosting services.
• If an IP range or IP address has been black-listed as a result of a spam complaint, Hosting4Wealth.net will issue a fine of $500 and may terminate the service.
• Upon receiving complaints, Hosting4Wealth.net will notify the client by issuing an abuse notification.
  • On the first notification, Hosting4Wealth.net will warn the client, as well as issue a $50 fine.
  • On the second notification, Hosting4Wealth.net will issue a fine of $50.00 per complaint received, with a maximum of 5.
  • On the third complaint, Hosting4Wealth.net will terminate service as well as issue a fine of $50.00 per additional complaint received, with a maximum of 10.
• Compromised Servers Issued Spam Notifications: If Hosting4Wealth.net suspects that a client's server or account has been infiltrated in an effort to send Spam/Bulk e-mail, Hosting4Wealth.net will offer the following options:
  • Offer a free Operating System reinstallation, setting the configuration back to the original state it was provisioned in.
  • If Operating System reinstallation is not accepted as an option, Hosting4Wealth.net may offer to manually retrieve/repair the files on the server, at a fee to be assessed and paid prior to any work being done.
  • On the second instance of server compromise Hosting4Wealth.net reserves the right to terminate the client's services.

If any Spam complaints are disputed, and fines wish to be disregarded, full logs, as well as any requested information must be provided within 24 hours of the initial Abuse Notification. Failure to dispute, or provide required information within the 24 hour time period is acceptance of the notification, and all fees associated with it.

Users must configure any email server in such a way that it will not accept third party emails for forwarding such as an open relay. SMTP servers must be configured in such a way that any user must authenticate to send email. (For Dedicated Server)

Hosting4Wealth's Abuse Desk will not send/forward complaints to users for the purposes of listwashing. Should a user have received permission from Hosting4Wealth's Abuse Desk to run a true "Confirmed Opt-in" campaign, complaints will be handled in such a fashion that the sender may remove the recipient from their list after they have proven to the Abuse Desk that the user did opt-in. Any approved campaign found to be operating using third party "bought" lists where opt-in confirmation cannot provided, service will be suspended. Further, time stamps and IP addresses in a database with a recipient's mail address WILL NOT suffice as sufficient proof of Confirmed Opt-in. We will need to inspect the confirmation emails' headers to make sure @aol came from aol servers, etc. Recording a time stamp, email address and IP address is not Confirmed Opt-in.

DMCA -17 USC §512 "DMCA"

Violations of 17 USC §512 "DMCA" will be promptly handled by Hosting4Wealth by means of notification. After receiving notification of DMCA violation(s), Hosting4Wealth will act promptly to notify the infringer of the identified infringement. Should a user of Hosting4Wealth not respond to the notice of our Abuse Desk, the infringed material will be blocked, filtered or otherwise be suspended until the user complies. Notice of infringement should be sent to abuse[AT]hosting4wealth.net 

Notification

• A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. [As an electronic signature, Hosting4Wealth's agent accepts facsimile/fax and digitized image of your signature attached to electronic mail.
• Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
• Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material. [Please include a URL such as http://... or ftp://... identifying the material or representative material. If possible specify any IDs, passwords, or other authorization required to access the material. Please specify date, time, and time zone from which the material was observed. Technicians may require time information in order to identify dynamically assigned internet locations.]
• Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
• A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
• A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Server Abuse

Hacking, cracking, distribution of viruses, fraudulent activities, network sabotage, pyramid schemes, phishing, and/or any conduct deemed illegal or unwanted shall be subject to suspension or termination. Users are responsible for the proper secure configuration of their services and are responsible for any damages caused by their neglect or exposure of vulnerabilities whether intentional or unintentional.

Any attempts to undermine or cause harm to a Hosting4Wealth server or customer of Hosting4Wealth is strictly prohibited.

Any sub-networks of Hosting4Wealth and dedicated servers must adhere to the above policies. The failure to meet or follow any of the above guidelines are grounds for account deactivation. We reserve the right to remove any account without prior notice. User agrees to only use shared hosting services for its intended applications. Misuses include scientific/grid/distributed computing, data warehouse/backup storage, or bandwidth sinks. Hosting4Wealth. will be the sole arbiter to what is considered a misuse of service.

User agrees to ask Hosting4Wealth. in the event they are unsure of their application's fitness for our shared hosting services.

Actions Taken by Hosting4Wealth

The failure by a customer to meet or follow any of the above policies/terms is grounds for account deactivation. Hosting4Wealth will be the sole arbiter as to what constitutes a violation of the AUP. Hosting4Wealth reserves the right to remove any account without prior notice.

When Hosting4Wealth becomes aware of an alleged violation of its AUP, Hosting4Wealth will initiate an investigation. During the investigation, Hosting4Wealth may restrict a customer's access in order to prevent further potentially unauthorized activity. Depending on the severity of the violation, Hosting4Wealth may, at its sole discretion, restrict, suspend, or terminate a customer's web hosting account and/or pursue other civil remedies. If such violation is a criminal offense, Hosting4Wealth will notify the appropriate law enforcement authorities of such violation.

Hosting4Wealth does not issue credits for outages incurred through service disablement resulting from AUP violations.

Hosting4Wealth customers agree to indemnify and hold harmless Hosting4Wealth from any claims resulting from the use of our services that damages them or any other party. The Hosting4Wealth service is provided on an as is, as available basis without warranties of any kind, either express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose or non-infringement. Hosting4Wealth expressly disclaims any representation or warranty that the Hosting4Wealth service will be error-free, secure or uninterrupted. No oral advice or written information given by Hosting4Wealth, its employees, licensors or the like, will create a warranty; nor may you rely on any such information or advice. Hosting4Wealth and its partners and suppliers will not be liable for any cost or damage arising either directly or indirectly from any transaction or use of the service.

Modification

Hosting4Wealth reserves the right to add, delete, or modify any provision of this Policy at any time without notice.

Release of Liability

Ability to restrict conduct, communication or content which might violate this Acceptable Usage Policy prior to introduction to Hosting4Wealth's network is not practical. Hosting4Wealth's failure or overlook of any violation of this AUP does not constitute a waiver of Hosting4Wealth's rights.

Remuneration

Hosting4Wealth users that violate this AUP or any provision herein may possibly incur fees in regards to clean-up or repair of any harmed devices, block listings, service interruptions, etc. Fees will be commensurate with the violation's severity.

Refusal Of Service

We reserve the right to refuse, cancel, or suspend service at our sole discretion.
